The construction of Brazil´s banking regulation institutional identity: an analysis in the light of the path dependence theory
O artigo tem por objetivo analisar o processo de construção dos arranjos institucionais da regulação bancária à luz da teoria da dependência de trajetórias (path dependence theory). O autor sustenta que a estrutura institucional vigente, baseada na repartição de competência entre o Conselho Monetário Nacional e o Banco Central do Brasil, é desnecessariamente burocrática e complexa. A partir de uma análise histórico-evolutiva do setor, argumenta-se que fatos antecedentes da história da regulação bancária brasileira acabaram por erigir grandes entraves, restrições e limitações ao processo de definição do aparato institucional de regulação e supervisão bancárias. Aplicando a teoria da dependência de trajetórias, o autor conclui que o modelo institucional vigente de regulação bancária brasileira sofreu, na verdade, um travamento por questões históricas, de modo que sua trajetória de construção acabou marcada pela autorreprodução ou autorreforço das estruturas, o que dificultou a concepção de um arcabouço regulatório mais racional.
The article aims to analyze the process of construction of the institutional arrangements of banking regulation in Brazil in the light of path dependence theory. The author argues that the institutional structure in place in Brazil, based on the division of powers between the National Monetary Council and the Central Bank of Brazil, is unnecessarily bureaucratic and complex. From an analysis of history and evolution of the sector, it is argued that facts history of the history of banking regulation in Brazil came to erect high barriers, restrictions and limitations of the process of defining the institutional arrangements for regulating and supervising banks. Applying the theory of dependence of trajectories, the author concludes that the institutional framework of banking regulation in Brazil suffered, in fact, a lock-in by historical events, so that its trajectory of construction was marked by self-reinforcement of structures, making it difficult to design a more rational regulatory framework.
